Thank you for your interest in Amigos Funding. By submitting a funding application, you agree to the following terms and conditions:
The application is an intake tool that allows us to review your funding request in an organized manner. Submission of an application does not guarantee that you will receive financing, an approval, a term sheet, or any agreement of any kind.
Amigos Funding works exclusively with business and investment-purpose transactions. We do not provide, arrange, or discuss financing for personal, family, or household use, and we are not a bank, consumer lender, or licensed mortgage broker. Depending on your deal, funding may come from Amigos Funding directly or from an independent capital source within our network; any funding from an independent source is subject to that source’s own review, terms, and approval.
All introductions to capital sources are made by and through Amigos Funding. You agree that you will not contact, negotiate with, solicit, or transact directly or indirectly with any lender, investor, or capital source introduced to you by Amigos Funding, and that all communications regarding your file will run through Amigos Funding. Any attempt to circumvent Amigos Funding may result in the immediate termination of your file and the pursuit of any remedies available to us.
Terms are quoted per deal and are based on a combination of factors including loan-to-value, credit, and experience, and are subject to change. Any rates, fees, or charges referenced in our materials are estimates only, determined by market conditions, capital sources, and risk-based pricing; they are not set, recommended, or approved by any state or federal agency. Rental financing is for non-owner-occupied properties only; cash-out LTV is based solely on appraised value, not cost basis. No terms are final until fully executed final documents.
You certify that the information provided in your application is true, accurate, and complete to the best of your knowledge, and you agree to notify us immediately of any changes. False statements, misrepresentations, or omissions of material fact may result in rejection of your application, termination of any agreement, and/or legal action.
You agree that we may contact you by phone, SMS/text message, email, or mail regarding your application and our business operations. Message and data rates may apply; reply STOP to opt out of text messages at any time.
Acceptance or declination of any application is solely at our discretion, and we may decline any application for any lawful reason, including without limitation credit history, collateral, experience, property location, or failure to meet our criteria.
Nothing in our application, website, or communications constitutes legal, tax, or financial advice. You are encouraged to consult your own advisors before entering into any transaction.
You agree to indemnify, defend, and hold Amigos Funding, LLC and its members, officers, and affiliates harmless from any and all claims, damages, losses, costs, and expenses arising out of or related to your use of our services or your breach of these terms and conditions.
These terms and conditions constitute the entire agreement between you and us regarding the application process and supersede any prior or contemporaneous agreements, communications, or representations. Any dispute arising out of or related to these terms or your use of our services shall be governed by the laws of the State of Texas and resolved exclusively in the courts of Bexar County, Texas.
If you do not agree to these terms and conditions, please do not submit an application. By submitting your application, you acknowledge that you have read, understood, and agreed to these terms and conditions.
